Since 1989, it has been a Texas law that a person who advertises or promises to provide a good or service and to pay all or part of the insurance deductible or a rebate for part of the insurance deductible is committing an offense, and a homeowner who submits a claim that violates the former is also committing an offense and is a class A misdemeanor. There are three typical free roof scams, but all defraud the insurance company and if you’re caught you could face significant fines, and even jail time. Is saving a few hundred dollars truly worth it?

There are three common ways unscrupulous roofers will offer to pay for your deductible, and all three all illegal and should be avoided. These include a roofer “eating your deductible,” inflating the invoice to cover your deductible or advertising deductible reimbursement/allowance. All three of these offers violate the law by either promising to pay for or rebate your insurance deductible. If your insurer asks for proof of payment or cost on any of these scams then you will still owe your deductible at best, and at worst you could be found guilty of insurance fraud.
